1. What Information Do We Collect?
Personal Information You Disclose To Us
In Short: We collect personal information that you voluntarily provide to us.
If you contact us for support or feedback, we may receive your email address and any information you choose to include in your message. We use this information only to respond to your request and maintain support records as needed.
Sensitive Information
Ambient Audio includes optional sleep and audio features that may involve sensitive information. This may include sleep sessions, Apple Health sleep stage data accessed with your permission, microphone sleep audio recordings, and custom sound recordings. This information is stored locally on your device unless you choose to share it with us, such as by including details in a support email.
Payment Data
If you purchase a subscription, payment is processed by Apple through the App Store. We do not receive or store your full payment card details. Apple may process payment information according to Apple's Privacy Policy and App Store terms. Apple's Privacy Policy is available at https://www.apple.com/legal/privacy/.
We may receive information needed to manage access to subscription features, such as subscription status, product identifiers, transaction identifiers, receipt information, and entitlement state.
Application Data
If you use Ambient Audio, the app may request permission to access the microphone and Apple Health sleep data. You can grant or revoke these permissions in iOS Settings, the Health app, or within Apple permission prompts.
We do not collect your GPS location, contacts, camera photos, social media profile information, or government identifiers. We do not use third-party advertising, remarketing, or analytics tools.
2. How Do We Process Your Information?
In Short: We process information to provide and operate Ambient Audio, respond to support requests, manage subscriptions, comply with law, and protect our rights.
We process information for the following purposes:
- To provide app features, including sound playback, favorites, presets, timers, wake alarms, custom sounds, sleep tracking, optional sleep recording, and optional Apple Health sleep-stage import or export.
- To respond to support and feedback messages you send us.
- To manage subscription access through Apple App Store purchase information.
- To comply with legal obligations and respond to lawful requests.
- To protect an individual's vital interests where necessary.
3. What Legal Bases Do We Rely On To Process Your Information?
In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason to do so under applicable law.
If you are located in the European Economic Area, United Kingdom, Switzerland, or Canada, we may rely on the following legal bases:
- Consent. We may process information when you grant permission, such as microphone or Apple Health access. You can withdraw this consent through device settings.
- Performance of a contract. We may process subscription-related information to provide paid features you purchase.
- Legitimate interests. We may process support messages to respond to you and maintain the Services.
- Legal obligations. We may process information when needed to comply with applicable law.
- Vital interests. We may process information where necessary to protect the vital interests of any person.
5. How Long Do We Keep Your Information?
In Short: We keep information only for as long as necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.
Most Ambient Audio data is stored locally on your device and remains there until you delete it in the app, remove the app, or otherwise delete it through device storage controls. Support emails are retained for as long as needed to respond to your request, maintain support records, and comply with legal obligations.
6. Do We Collect Information From Minors?
In Short: We do not knowingly collect personal information from children under 13 years of age.
Ambient Audio is not directed to children under 13. If we learn that we have collected personal information from a child under 13, we will take reasonable steps to delete it. If you believe a child has provided us personal information, please contact us at pdev0522@yahoo.com.
7. What Are Your Privacy Rights?
In Short: Depending on where you live, you may have rights that allow you to access, correct, delete, or restrict certain personal information.
You may contact us to request access to, correction of, or deletion of personal information we hold about you. You can also delete local app data in Ambient Audio Settings and revoke Apple Health or microphone permissions through iOS Settings or the Health app.
If you are located in the EEA, UK, Switzerland, or Canada, you may have additional rights under applicable data protection laws. These may include the right to request access, rectification, erasure, restriction, portability, withdrawal of consent, or objection to certain processing.
If you are located in the EEA or UK and believe we are unlawfully processing your personal information, you may also have the right to complain to your local data protection authority.
8. Controls For Do-Not-Track Features
Most web browsers and some mobile operating systems include a Do-Not-Track feature or setting. At this stage, no uniform technology standard for recognizing and implementing Do-Not-Track signals has been finalized. We do not currently respond to Do-Not-Track browser signals.
We do not use third-party tracking or advertising tools in Ambient Audio.
9. Do United States Residents Have Specific Privacy Rights?
In Short: If you are a resident of certain US states, you may have specific privacy rights. These rights may be limited in some circumstances by applicable law.
